1 + 1 loses a case to New Channel

The Commercial Court of Kiev partially allowed the claim of New Channel against  broadcasting company 1+1 LLC and foreign company 1+1 Production on violation of the copyright and recovery of compensation. The claim concerned the TV show Inspector Freimut, which according to the plaintiff is identical by content to the TV show Inspector of New Channel. The court obliged the defendants to halt violation of the copyright of New Channel to the literary work — a typical scenario of the TV show Inspector — and creation of similar works, including the TV show Inspector Freimut. It prohibited distribution of the TV show Inspector Freimut and the making of copies of video recordings, notification, distribution, or any use thereof under current legislation of Ukraine. The court obliged the defendants to pay the sum of UAH 1.2 million in compensation to New Channel.

 

Naftogaz wins UAH 780 million from JSC Azot

The Kiev Commercial Court of Appeal obliged JSC Azot to repay UAH 780.29 million to SE Gas of Ukraine (affiliated with Naftogaz of Ukraine). On 21 February 2012 the Commercial Court of Cherkassy Region allowed the claim of Naftogaz of Ukraine against JSC Azot on collection of UAH 373.9 million of the principal debt, UAH 6.7 million in fines, UAH 8.02 million in inflation losses, UAH 1.4 million in the 3% annual rate, and court costs. JSC Azot decided to contest the judgment and filed an appeal with the Kiev Commercial Court of Appeal requesting to annul the judgment. On 11 February 2015 the court upheld the judgment of the court of first instance.
