Far-reaching Consequences

Anti-corruption initiatives have become a worldwide trend over the last few years. The far- reaching consequences of the US Foreign Corrupt Practices Act (FCPA) and UK Bribery Act ensured a global impact on doing business and legal services in particular. In developed countries the role of banks and other financial institutions in preventing corruption and fraudulent practice is extremely high. Foreign anti-corruption practices have also reached Ukraine and brought the queries of clients to the table of business lawyers.

The Ukrainian government has declared a war on bribes and corruption as a state strategic priority. Legislators were fruitful in designing new state programs and laws. Unfortunately, the enforcement side remains weak and the reality contrasts quite greatly with proclaimed policy objectives. Ironically, national and international observers have given quite “modest” assessments. This “disease” could be overcome not only by strict laws and law-enforcement proceedings, but by the fundamental transformation of the social conscience.
