Anti-subsidy investigations

The Draft Act On Changes to the Act of Ukraine on Protection of Domestic Manufacturers against Subsidized Imports (procedures of anti-subsidy investigations and countervailing measures) of 3 Novem- ber 2014, No.5192 has been submitted by the Cabinet of Ministers of Ukraine. The Draft was developed due to the need to bring the existing On Protection of Domestic Manufacturers against Subsidized Imports Act of Ukraine into compliance with provisions of the Agreement on Subsidies and Compensatory Measures of 15 April 1994. The main purpose of this Draft is to regulate issues concerning calculation of a recipient’s benefit; determination of the types of subsidies in accordance with international law; improving the procedure to obtain information during anti-subsidy investigations; expanding the list of economic determinants that are examined during anti-subsidy investigations to identify any harm caused to domestic manufacturers.

 

Waste management

The Draft Act On Changes to the Code of Ukraine on Administrative Offenses in the Field of Waste Management of 11 Novem- ber 2014, No.5195 has been submitted by the Cabinet of Ministers of Ukraine. The aim of the Draft is to strengthen the government’s influence on the officials of executive agencies and local authorities, who commit offenses while issuing licensing documents, and the business entities that commit offenses in the field of entrepreneurship. The Draft expands the list of administrative offenses committed by officials of executive agencies and local authorities while issuing licensing documents. The Draft also expands the list of officials of the executive agencies and local authorities’ governments, whose offenses can be reported in appropriate protocols of authorized public administrators. In the field of waste management, the document provides for penalties for business entities for waste management operation without relevant permits, as well as for violations of the procedure of reporting waste and failure to provide such reports.
