Roshen tries to protect Vanilla Sky brand

Ukrainian confectionery corporation Roshen has submitted a claim to the Intellectual Property Court (the IP Court) of Russia on early termination of legal protection for  the “Vanilnoe Nebo/Vanilla Sky” trademark, as registered by OJSC Novosibirsk Refrigerating Plant.

The plaintiff asks to cancel registration of some NICE 30 class goods, namely coffee, tea, sugar, rice, bakery, confectionary and ice cream. In Roshen’s opinion, the defendant hasn’t been using the owned brand for three or more years. According to Russian legislation, a party contesting trademark registration has to establish to the satisfaction of the court its interest in using a trademark.

The IP Court scheduled the main hearing in the claim for 20 October.

 

Zeonbud sued Tonis for UAH 20 million

The monopoly digital TV service provider Zeonbud has sued the TV Channel Tonis with the aim of recovering a debt of UAH 19.6 million.

Notably, only several days before bringing the above-mentioned case, Zeonbud abandoned an identical claim against Tonis for the much larger sum of UAH 61 million.

It is worth mentioning that Zeonbud provides TV signal transmission within its digital networks for 28 Ukrainian national channels as well as for a number of regional ones. Some channels stopped paying the provider, giving as a reason that signal coverage is insufficient and people do not have as many tuners in their possession as they are supposed to have.
