Chamber Meeting on Overview of European Cybersecurity Implementation

On 9 December the Chamber held a meeting devoted to the presentation of Overview of European Cybersecurity Implementation. During the meeting the Information Systems Audit and Control Association (ISACA) presented the Ukrainian translation of the document and outlined the main points of it. This is the first Cybersecurity guideline available in Ukrainian. The ISACA also provided recommendations on Cybersecurity in Ukraine, among them being the need to use a strategy, EU directives and international best practices in the development of Ukrainian legislation and cyber strategy; the need for greater involvement of business in the process; the necessity for creation of organizations on cyber security on the basis of self-regulation and industry standards; active introduction of mature corporate governance practices and their integration into cybersecurity, etc.

 

Chamber Customs Committee Meeting

On 17 December the Chamber Customs Committee held its meeting with participation of representatives of the State Fiscal Service of Ukraine, devoted to discussing the practical aspects related to implementation of the Deep and Comprehensive Free Trade Area (DCFTA) within the EU-Ukraine Association Agreement starting from 1 January 2016. The SFS was namely represented by Volodymyr Storozchuk, head of Rules of Origin Unit of Department of Administration of Customs Duties and Tariff Regulation and Maryna Halturyna, chief state inspector of the Customs and Tariff Regulation Unit of Department of Administration of Customs Duties and Tariff Regulation. Following the presentation on key aspects of the Association Agreement between Ukraine and the EU, including DCFTA, by the State Fiscal Service, Oksana Drozach, PwC, Chamber Customs Committee co-chair moderated the panel discussion regarding the following issues: requirements for documents confirming the origin of goods to apply preferences, schedule of customs duties reduction and administration of tariff quotas and special measures for “second-hand”. As a result of the meeting it was agreed to develop and provide the SFS with the Chamber’s proposals regarding the peculiarities of customs clearance of preliminary declarations “EA” type in regard to EUR 1 certificates submission; to organize meetings with SFS representatives in 2016 regarding other practical aspects related to DCFTA based on first results of its application and continue to cooperate with SFS representatives so as to receive clarifications in response to the requests of Chamber Members.

 

Chamber Banking & Financial Services Committee

On 18 January the Chamber Banking and Financial Services Committee met to discuss a number of important issues, among them — NBU Resolution No.778 on the use of measures in response to the violation of banking laws. It was decided to address the NBU with a request to issue an NBU explanatory letter to Resolution No.778 in proper legal form, as well as to draft a separate letter the Chamber’s proposals on how Resolution No.778 and respective indicators need to be modified and a letter regarding the liability of banks undertaken for conducted operations.  The next point for discussion was the Chamber and Center for Economic Strategy Draft Position Paper on cancelation of sanctions for violating the 90-days rule for receipt of export/foreign exchange revenues. Following the discussion it was decided that the Position Paper needs to be finalized with the members of the Chamber’s expert group before submission to the Minister of Economic Development and Trade.  At the end, participants got a brief overview of the  results of the meeting with Ruslan Demchak, deputy chairman of the Committee on Financial Policy and Banking, where two main business proposals were discussed, in particular: the upper limit of a loan amount (UAH 500,000) that can be considered as a consumer loan, including the opportunity to exclude the mortgage loan from the application of Draft Act No.2455 and clarification of intermediation in consumer lending;  as well as draft proposals by the Chamber to Draft Act No.2455 On Consumer Loans which was voted on in the first reading by VRU on 9 December 2015. To this end, the Committee agreed to submit the Position Paper with the Chamber’s Comparative Table to leaders of the VRU.
