KPMG Law Ukraine represented interests of an agro-industrial company in a tax dispute

KPMG Law Ukraine represented interests of an agro-industrial company in a tax dispute regarding value added tax refunding in connection with transactions alleged by the tax authority as fictitious. 

The tax authorities conducted a documentary unscheduled tax audit of the Company, which led to the conclusion on fictitiousness of grain purchase transactions, since they are not supported by records of the Unified Register of Tax Invoices throughout the supply chain. On this basis, tax authorities reduced Company’s VAT recoverable amount.

The Company disagreed with the above conclusion and engaged lawyers from KPMG Law Ukraine who succeeded in defending the Company's interests at the court of the first instance.

In the course of litigations, KPMG Law Ukraine team succeeded in refuting tax authority's findings with regard to overstatement of recoverable VAT and overstatement of negative amount to be included in tax credit of the next reporting period.

The engagement was led by Kostiantyn Karpushyn, partner, Tax & Legal, and Larysa Antoshchuk, attorney, the head of Tax Dispute Resolution Practice.  Natalia Musienko, Yurii Oliinyk, and Sofia Baranovska were also involved in the engagement.
