KPMG Law Ukraine lawyers have successfully defended business interests

The Tax Dispute Resolution Practice lawyers of KPMG Law Ukraine successfully defended the interests of the leading developer of trade centers in Ukraine in a dispute with the fiscal authorities on correct recording of data in the electronic VAT Administration System.

The tax authorities arguments were that the business had no right to use the VAT credit amounts for settlement of the current tax liabilities and to increase the registration amount in the electronic VAT Administration System. The Tax Dispute Resolution Practice had proved in the court that the negative VAT balance could be used to reduce VAT liabilities and to simultaneously increase the registration amount in the electronic VAT Administration System in any period and without any restrictions. As a result of legal proceedings, the right of the Company for the legal recording of the negative VAT balance was restored and the applicable penalties were cancelled.
